Additional Notice for Virginia Residents
This Addendum to the Privacy Notice applies to residents of Virginia only.
Collection of Personal Information
We collect personal information about you:
- Identifiers and personal information such as name and contact information (see Website Direct Data Collection)
- Commercial information such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies: We do not directly collect this information about consumers, but we may work with third party vendors who do and who provide that data to us. We do not collect or associate name or contact information with such data, and we limit how we further disclose it (e.g, we don’t supply raw data we obtain from our third party vendors and only supply aggregated insights based on this raw data data in our Business Services. - Internet or other similar network activity including browsing history, search history, information on a consumer’s interaction with a websites, application, or advertisement (see Service-Related Data Collection above).
- Geolocation data, including physical location or movements: We do not directly collect this information about consumers, but we may work with third party vendors who do and who provide that data to us. We do not collect or associate name or contact information with such data, and we limit how we further disclose it (e.g, we don’t supply raw data we obtain from our third party vendors and only supply aggregated insights based on this raw data in our Business Services). - Sensory data such as audio, electronic, visual, thermal, olfactory, or similar information.
- Professional or employment information such as current or past job history or performance evaluations.
- Inferences drawn from other personal information such as a profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. We do not directly collect this information about consumers, but we may work with third party vendors who do and who provide that data to us. We do not collect or associate name or contact information and we limit how we further disclose it (e.g., we don’t supply raw data we obtain from our third party vendors and only supply aggregated insights based on this raw data in our Business Services. Purposes for Which Personal Information Is Purchased or Collected
The purposes for which we will collect or use your personal information are described in the How We Use Information We Purchase section in our notice and include:
- To fulfill or meet the reason you provided the information.
- To operate, improve or maintain our Sites.
- To respond to your online inquiries and requests, and to provide you with information and access to resources or services that you have requested from us.
- To comply with our legal and regulatory requirements.
Disclosure of Your Personal Information
We do not share your information with third parties for a business or commercial purpose.
We may share information to comply with law, to protect the interests of ourselves or others, and in connection with a merger, sale, or acquisition of all or part of our business. To learn more about how we share data, please see the How We Share Personal Information section.
Your Virginia Privacy Rights
If you are a Virginia resident, you have the following rights to your personal information.
- Right to Opt-Out of Certain Targeted Advertising. If Motionworks ever engages in cross-contextual behavioral advertising, then you will have the right as permitted under law to opt out. At present Motionworks does not use third party analytics on its websites.
- Right to Confirmation and Access. You have the right to request that we confirm whether we are processing your personal information and you have the right to access the personal information we have processed about you.
- Right to Correct. You have the right to correct inaccurate personal information. In certain circumstances, we may not be able to satisfy this request depending on the nature of the personal information and purposes for maintaining it.
- Right to Delete. You have the right to request that we delete your personal information that you have provided to us or that we have obtained about you. We may deny your deletion request if retaining the information is permitted under law.
- Right to Opt-out of Selling. You have the right to direct us to not sell your personal information at any time. To exercise the right to opt out, you (or your authorized representative) may submit a request to use by visiting our Do Not Sell or Share My Personal Information page.
- Right to Data. You have the right to obtain a copy of the personal information that you previously provided in a portable and, as technically feasible, readily usable format that allows transmission to another data controller without hindrance. The right to obtain in such a portable, usable form may only apply to data that is processed via automatic, standardized means.
- Right to Opt-Out of Profiling. You have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
We may limit our response to your request to exercise the above rights as permitted by law.

Please note that we may take steps to verify your identity before granting you access to information or acting on your request to exercise your rights. In connection with such verification, we may ask you to provide your name and mobile device identifier. We may limit our response to your exercise of the above rights as permitted by law.
